    How does Wasabi handle reports of CSAM?

    Wasabi does not monitor Customer content nor access stored content for the purposes of providing and supporting the Service. However, Wasabi expressly prohibits the use of its Services to store child sexual abuse material (CSAM). Despite this prohibition, Wasabi does occasionally receive notices that CSAM is being stored in a Wasabi bucket. Upon receipt of a credible report that CSAM is being stored, Wasabi validates that the link to the CSAM content is live / accessible. Wasabi does not view the CSAM content itself. Upon verification that the complained-of content remains accessible, Wasabi will temporarily suspend the account, disable the account-owner’s access, and make the content publicly inaccessible. Notification of suspension is promptly provided to the account owner unless prohibited by law. 

     

    If a Customer believes their account was improperly suspended as a result of being tagged as storing CSAM, they may appeal Wasabi’s decision within 72 hours of notification of such suspension by emailing support@wasabi.com. The appeal will be reviewed and if it is determined that a mistake was made or that other good cause exists to reinstate, we will promptly reinstate the account. If Customer fails to timely appeal, or if Wasabi determines that the suspension was proper, the account will be permanently deleted and closed, and any content stored on the account will be preserved and/or deleted as determined by Wasabi in accordance with applicable law and company policy. Wasabi maintains absolute discretion to determine the validity of account closure and content deletions, and its determination on appeal is final and binding. Customer will not be entitled to any sort of credit or refund for pre-paid fees if their account or content are deleted and/or closed due to a CSAM violation.

     

    Wasabi will promptly report any CSAM complaints to NCMEC (and any other agencies or entities as may be required by applicable law), along with the account holder’s name and other relevant information. NCMEC will ultimately review and evaluate the report and determine whether reference to law enforcement is appropriate. Wasabi cooperates with all lawful investigations made through a valid legal process or in accordance with applicable law and company policy.
